Harare Regional Magistrate, Mr Noel Mupeiwa is this Friday expected to make a determination on who pays the legal costs incurred by complainants in the successful prosecution of Munyaradzi Kereke.
Last week the court called the office of the prosecutor general to come and explain their failure to prosecute Kereke with the view that the office is expected to meet the legal costs incurred by Mr Francis Maramwidze in hiring a private prosecutor Mr Charles Warara.
The office of the prosecutor general however argued that it had nothing to do with the case adding Mr Johanese Tomana in his personal capacity is responsible for the failure to prosecute Kereke hence the need for him to make an explanation.
The case of Kereke is a unique case in the judicial calendar of Zimbabwe which has seen a private citizen successfully prosecuting a complainant after the state was seen to have failed to do so.
It is after the conviction and imprisonment of Kereke that the citizen is now demanding compensation for performing duties of the state in achieving justice.
