The Zimbabwe Anti-Corruption Commission (Zacc) late Tuesday announced it had arrested Zanu PF MP Psychology Maziwisa and State broadcaster ZBC presenter Oscar Pambuka.

The two were involved in a scam that creamed State power supplier Zesa of tens of thousands supposedly for public relations work through a shadowy company known as Fruitful Communications they co-own.

Zacc spokesperson Phyllis Chikundura confirmed the arrests.

“It is true they were arrested today (Tuesday) and they are being held at Avondale Police Station. They are expected to appear in court tomorrow (Wednesday). Charges against the two are related to their dealings with Zesa,” Chikundura said.

Former Energy Minister Samuel Undenge has also been arrested over the same issue and is currently on bail. Undenge inked the deal with Fruitful Communications.

The arrests are part of a wider crackdown on leading figures of a faction of Zanu PF known as G40 that had former President Robert Mugabe’s support but lost in the game of thrones with President Emmerson Mnangagwa’s Team Lacoste group that swept to power on the back of a military coup in November.

The operation has also netted former foreign affairs Minister Walter Mzembi, his ex-Finance counterpart Ignatius Chombo and former Zanu PF youth league leader Kudzanai Chipanga. -NewZim

Businessman Bigboy Pachirera claims that sometime in December 2013, Chihuri caused his unlawful arrest on allegations of theft and that he was over detained and released willy-nilly without going to courts.

Through his lawyer Rungano Mahuni, Parichera claims that after his release from custody Chihuri ordered the police to harass, steal and rob him of his property.

Mahuni claims that Chihuri ordered that several of his vehicles were taken to the vehicle theft section at Southerton Police Station for verification where he was tortured and harassed.

Pachirera is claiming US$500 000 in property value which includes a house and two vehicles while US$1.4 million is for damages in loss of business during the time he was being harassed. US$1 million is being claimed for psychological lesion.

PROPHETIC Healing and Deliverance Ministries leader, Walter Magaya is set to face his rape trial after the High Court has set April 3, 2018, as the date on which the trial will commence.

Magaya’s Constitutional Court (ConCourt) challenge was last year struck off the roll. On top of the charge, Magaya will now face unlawful termination of pregnancy and obstructing and defeating the course of justice charges, according to the notice of set down filed on Wednesday 10 January 2018.

The ConCourt, sitting as a full bench, could not hear the application on the basis that his legal counsel of Thabani Mpofu, instructed by Rubaya and Chatambudza Law Firm, filed faulty papers in court. Magaya was challenging his indictment for trial at the High Court.

The controversial church leader was arguing that he could not be tried for a rape case, where the complainant in the matter had voluntarily withdrawn the case.

The Prosecutor-General’s Office insisted they wanted to go ahead with the trial even after the complainant in the matter said she did not wish to pursue the sexual assault charge.

Magaya had argued that the State had no right to proceed with the trial after it had lost both the complainant and its sole witness.

FORMER Netone Boss Kangai Granted $800 Bail

A Harare magistrate has granted former Netone chief executive Reward Kangai $800 bail after he appeared at the courts facing charges ranging from criminal abuse of office, corruption and misconduct
Harare Magistrate Rumbidzai Mugwagwa ordered the former Netone boss to deposit $800 bail with the clerk of court, surrender his passport, report to the police once every week and not to interfere with
witnesses.

Magistrate Mugwagwa remanded the matter to 31 January 2017.
The State represented by Linda Gadzikwa did not oppose the granting of bail.
Kangai’s lawyer Nyasha Munetsi tried to challenge the legality of the
arrest by the Zimbabwe Anti-Corruption Commission (ZACC) arguing that
the anti-graft body did not fully investigate the matter.
For State, Gadzikwa is alleging that sometime in October 2014, Kangai
unlawfully and corruptly sanctioned payment of rentals in advance to
four base station landlords without authorisation and approval from
the board of directors.
Gadzikwa told the court that Kangai allegedly showed favour to Bopela
Family Trust by sanctioning the advance rental payment of $10 500
which covered a period of one year nine months.
Richwood Sports Club was paid $33 000 which covered a period of five
years while Avondale Christian Church was paid $27 000 which covered
three years.
It is alleged that house No. 514 Chipembere Road Windsor Park in Ruwa,
Harare was paid $5 400.
The court also heard that NetOne has no provision for advanced rental
payments and the lease agreements entered between the company and base
station landlords were done fraudulently.
It is alleged that Kangai’s conduct was prejudicial to NetOne and
other landlords whose rentals were not paid.
Kangai also approved a loan of $80 000 to Bopela Group (Pvt) Ltd
without the approval of the board. It is alleged that the loan approval
was outside the mandate of NetOne.
The company lost $155 900.
The court heard that between January 2014 to December 2015, Kangai
unlawfully failed to comply with the Procurement Act Chapter 22:14
particularly section 8 of Statutory Instrument 171 of 2002 and
Statutory instrument 126 of 2015 in the selection and engagement of
service providers.
It is alleged that Kangai handpicked Espol Advertising (Pvt) Ltd,
Sectional Poles South Africa, Convergys (Pvt) Ltd, Bopela Group (Pvt)
Ltd, Gemalto (Pvt) Ltd, Afrosoft (Pvt) Ltd and Imago Communications.
The total tender value for the above companies was $17 594 700.
The court heard that on eight different occasions Kangai abused his
authority by giving directives to his subordinates on the acquisition
of base station sites.
The procedure required three survey reports before the final
selection. It is alleged that construction work at the sites commenced
without survey reports. The court heard that surveys were later done
as a cover up.
Sometime in 2014 again, it is alleged that Kangai ordered the
installation of a base station at stand No. 103 Goodhope along
Lomagundi Road. The property belonged to his aunt Joyce Kangai.
It is alleged that Kangai failed to disclose his personal interest and
relationship with Joyce.

ED Mnangagwa Wants Illegally Acquired Wealth Of Ex-ministers Forfeited to The State As Crackdown On Corruption Continues

$

0

THE Ministry of Justice, Legal and Parliamentary Affairs intends to conclude at least 20 high-profile corruption and economic crime cases within 100 days and those convicted will have their “illegally acquired wealth” forfeited to the state.

By Wongai Zhangazha

This is highlighted in Justice minister Ziyambi Ziyambi’s 100-day work plan which aims to reduce case overload at the National Prosecuting Authority (NPA), combat corruption and capacitate the prosecuting authority.

The Zimbabwe Anti-Corruption Commission (Zacc) is investigating a series of corruption cases and criminal abuse of office charges implicating former cabinet ministers who include Ignatius Chombo, Walter Mzembi, Walter Chidhakwa, Makhosini Hlongwane, Joseph Made and Samuel Undenge. Some of the cases are before the courts.

In terms of performance indicators, the Justice ministry said it would prioritise the “completion of at least 20 high-profile corruption and economic cases” as well as the “forfeiture of illegally acquired wealth on conviction of economic and corruption cases.”

The ministry also intends to curb corrupt practices such as withdrawal of cases by prosecutors.

The work plan states that there was rampant corruption among public prosecutors, most of whom are under-qualified. Fifteen prosecutors are set to be transferred in the next 100 days. To curb the challenges faced by the NPA, the ministry will recruit 102 qualified and degreed public prosecutors.

“Periodic rotations and transfers will reduce opportunities for corruption; restore confidence in the justice system and convictions will serve as a deterrent,” the work plan reads.

Because litigants in several rural areas have to travel up to 300km to access the courts, new courts will be opened in Manicaland and Matabeleland South provinces.

The Justice ministry also intends to open Mutasa provincial magistrate court and Chipinge and Plumtree magistrate courts.
The gazetting of resident magistrates’ courts in Concession, Karoi and Guruve is also part of Ziyambi’s 100-day work plan, all with the aim of enhancing public access to justice.

Meanwhile, in an interview on Tuesday, Ziyambi said the country’s current electoral laws are “the best in southern Africa and on the continent”. He said the harmonised elections scheduled for later this year can be held without reforms and still produce a free and fair outcome.

Civil society and opposition political parties have been calling for a reformed Zimbabwe Electoral Commission (Zec), arguing it is filled with security agents and has no credibility. The activists also argue that Zec has long been considered independent on paper only, while in reality operating at the beck and call of the ruling Zanu PF.
Laws such as the Public Order and Security Act (Posa) are seen as prohibiting citizens from taking part freely in the electoral process.

Opposition political parties have also requested that the voters’ roll be given to candidates on time. They have also demanded an improvement in voter education.

“We have a constitution that came into effect in 2013. The effect of it was that any law with parts that are inconsistent to the constitution ceased to exist whether they are aligned or not. The process of aligning legislation, be it electoral or not, is to clean up,” Ziyambi said.

“After all, our electoral laws meet Africa Union and Sadc guidelines. In fact, they are even better.
“In terms of conducting a free and fair election, we can achieve that. We have invited some non-governmental organisations to make presentations regarding what ideal electoral reforms are. Parliament is also deliberating on that and I am going to respond to those issues.”

Ziyambi would not be drawn into revealing who the next Zec chair will be, saying President Emmerson Mnangagwa was still in the process of consulting.

Speculation was rife that either Justice Vernanda Ziyambi or High Court judge Justice Loice Matanda-Moyo will replace former chair Rita Makarau who resigned in December last year without giving reasons.

“The President is doing necessary consultations to comply with constitutional requirements. The President appoints the next Zec chair after consultations with the Judicial Service Commission and parliament’s Committee on Standing Rules and Orders,” the Justice minister said.

“So if a certain candidate is considered, these different departments give their opinion to the president if he or she is suitable. If they have reservations they also state that. However, the appointment is going to be done very soon for the chair is needed urgently to move electoral processes.”-AMH

HELL hath no fury like a woman scorned! A 26-year-old Tsvingwe man is in an excruciating moment at Mutare Provincial Hospital after being scalded with hot cooking oil while asleep in a shocking act of domestic violence by his estranged wife over allegations of promiscuity.

Casilda Mavherevhedze (21)

Tinashe Mutsamba is admitted in the hospital’s burns unit, nursing severe burns to his face, neck, chest, hands and abdomen.

Promiscuous Jonathan Moyo ‘s Happiness: Minister denies extramarital affair with Herald journo

His wife, Casilda Mavherevhedze (21), argues she committed the offence out of anger and was fed up with Tinashe’s promiscuous and violent nature.

VICTIM . . . Tinashe Mutsamba recovering in Mutare General Hospital

Casilda allegedly fled her matrimonial home, abandoning her four- month-old baby, but Lady Luck eluded her when she was “arrested” by a mob while hiding at a relative’s place within the vicinity.

The incident occurred at house number 226, Tsvingwe high-density suburb, Penhalonga, on January 13, this year. The accused is facing charges under Section 4 as read with Section 3 (1) of the Domestic Violence Act Chapter 5:16 which make such conduct a punishable offence.

When The Weekender visited Tsvingwe high-density suburb on Monday the incident was fresh on the lips of shocked residents.

It was established that an altercation ensued on Friday January 12, 2018 evening with Casilda accusing Tinashe of being promiscuous and unfaithful to her. Tinashe denied the allegations and retired to bed at around 9pm. He left Casilda feeding the baby.

At around 1am, Casilda allegedly heated cooking oil and poured it on a sleeping Tinashe. He was burnt on the face, neck, and chest, among other body parts. Casilda fled the scene, leaving her baby unattended.

Tinashe screamed as he writhed in pain, drawing the attention of neighbours, who together with his mother Tsitsi Pasanduka rushed him to Mutare Provincial Hospital, where he is still admitted.

His mother made a report to police. A resident who was only identified as Marume said it was disturbing that such a young woman had plotted to eliminate her husband in such a callous manner.

“This is the second incident in Penhalonga for a woman to scald a husband with hot cooking oil. It is so disturbing to think that such a young woman has the guts to perpetrate such crude violence against her husband.

“We all know Tinashe is a ladies’ man; he loves ladies so much despite the fact that he is married and everybody in this neighbourhood knows that. On Friday, the couple had an altercation over Tinashe’s (alleged) infidelity, but he kept denying the allegations though,” said Marume.

Marume, who is the couple’s neighbour, said early on Saturday morning he heard loud screams from the couple’s house.

Sensing danger, he rushed to investigate and discovered that Casilda had committed the heinous act of cruelty and vanished from the scene.Another neighbour identified as Mai Makare likened Casilda’s conduct to an untamed horse.

“She is not cultured and should not have acted that way. We condemn her untamed ways. It’s an abominable thing to do. If she needed recourse, she should have approached either the civil court, family or community elders to address the matter. You cannot employ evil tactics to eliminate your husband while asleep, no,” she said.

Casilda has since appeared before Mutare provincial magistrate Mr Tendai Mahwe, who convicted her on her own plea of guilty. Her sentencing was adjourned to today (Friday). She is in remand custody.

The adjournment was meant to give prosecutor Mr Fletcher Karombe time to get and furnish him with Tinashe’s medical report. In mitigation, Casilda told the court that she was angry and revenging against her husband abusive nature. She said Tinashe was in the habit of assaulting her each time she raised issues of his alleged promiscuity.

“Your Worship, I had had enough of my husband’s abusive actions. Ever since we married last year, I have been his punching bag. He bashes me day and night, even when I was pregnant. I have a four-month-old baby, but that doesn’t matter to him at all as he keeps on assaulting me for no reason,” she said.

To bolster her defence, Casilda removed the pink and purple jacket she was wearing to expose before Mr Mahwe multiple scars on her body that she attributed to Tinashe’s attacks.-ManicaPost

The 15-year-old, who cannot be named as he is still a minor, has appeared in court for the alleged murder of the mathematics teacher, Kingston Vhiya, in Kuruman in the Northern Cape.

Witnesses say the incident happened last week ahead of schools re-opening, but the teenager could not proceed to the next grade because of low marks.

He allegedly vented his frustration on the teacher, with tragic consequences.

The alleged murder was committed on Tuesday when the student demanded to meet Vhiya outside his home on Tuesday night. A witness said the boy had blamed his low marks on Vhiya.

It is alleged the boy ran amok, smashing windows prompting the teacher to go out.

The boy suddenly pulled out at a knife, it is alleged, and stabbed the now-deceased. Fellow teachers overpowered the teenager leading to his arrest.

Laverage Murikito appeared before magistrate Nyasha Marufu claiming that his son Prosper was trying to drive him out of his own home by locking the gate whenever he intended to visit.

“He locks he gate from the inside every time I visit to see my wife. He took my gate keys and he is telling me to leave my house,” he said.

Murikito claimed that his son was abusing and vandalising his property. He also accused his son of disrespecting him by wearing his clothes.

“He has to leave my house. I want to live in peace with my wife and my other children.”

Prosper, however opposed his father’s application for a peace order, accusing him of lying to the court.

“He left the house in question, his own house, sometime in 2016 and since then I was the one taking care of my diabetic stepmother and my niece. We do not live with him,” he said.

In granting the peace order, magistrate Marufu encouraged Murikito to live in peace with his family and also advised him to use other legal processes if he wanted to kick his son out of the house.

A primary school teacher from Triangle who allegedly dated a married policewoman he met while on BVR duties was severely bashed in Rujeko, Masvingo after he travelled 200km to see his lover.

Sakina Mutanha

Sakina Mutanha

Francis Zimuto, a teacher at Dunusa Primary School hitchhiked all the way from Triangle to Masvingo to sleep over at his alleged lover Sakina Mutanha’s place without knowing that the person inviting and sending him Whatsaap love messages was the husband who had snatched away his wife’s phone.
Sources at the house where Mutanha lodged in Rujeko B confirmed the incident and said that Zimuto was battered by Mutanha’s husband Mugwenhi and his friends after walking into a trap at around 1am on December 30 2018.
“Zimuto has Police at Rujeko B to thank for their swift reaction which saw his life being saved. He was dragged from the road into the house where he was severely beaten,” said a source who declined to be named.
Mugwenhi who is also a Police officer working under CID confirmed the incident when called by The Mirror but declined to comment because Zimuto had pressed assault charges against him and the case was now before the courts.
Sources told The Mirror that Mugwenhi had for some time suspected an adulterous relationship between Mutanha who is an officer at Rujeko Police Station and Zimuto. The two met when they were in Mushandike during the  BVR program and allegedly fell in love.
After the BVR assignment, Mugwenhi realised that Zimuto continued to phone Mutanha and he warned him to stop the phone calls since their national duty together had ended. Zimuto apologised for the calls and said he was only calling because he wanted his $100 borrowed from him by his wife. The calls  ad messages to Mutanha however, did not end.
On the fateful day, Mutanha left the matrimonial bedroom in a huff and went outside and allegedly talked to Zimuto on the phone. When she came back into the bedroom Mugwenhi snatched the phone and left the house with it.
It is then that he allegedly sent a message to Zimuto telling him that Mugwenhi was not at home until the next day as he was out on duty. He sweet-talked Zimuto who was drinking at a bar in Triangle to find transport and come to Masvingo immediately. Zimuto who seemed to have been desperate for the opportunity left the bar in a huff at around 9pm and hitchhiked all the way to Masvingo where he arrived at around 1am.
He exchanged love messages with Mugweni all the way without knowing that he was communicating with the husband. At one time he complained that he was feeling cold as he was only wearing sandals but was told not to worry because Mutanha was going to make him warm.
Zimuto hired a taxi when he got to Exor but walked into a trap when he got to the gate to Mutanha’s lodgings. Mutanha who was sleeping in the bedroom was awoken by Mugwenhi who said he had nabbed a robber outside. Without suspecting anything she rushed outside only to confront her trapped lover.

Former Zimbabwe Police Chief Chihuri Printed Own Fake Spot Fine Books

WOES continue to mount on retired Police Commissioner-General, Augustine Chihuri, who now faces a possible criminal case of abuse of office and corruption.

BY BLESSED MHLANGA

Former police officer Tafadzwa Gambiza, fired from the force after refusing to cast his ballot in front of his commanders, has opened a case of corruption against Chihuri, demanding that he be brought before the courts.

The case, reported at Kwekwe Central Police Station and captured under RRB number 3284257, was made before Chihuri was fired.
Gambiza accuses Chihuri of illegally printing fake spot fine books which were not prescribed at law and converting the money to his own use, paying his top officers and abusing his position for self-enrichment.

“The accused designed his private national deposit fine schedules illegally usurping the mandate of the Ministry of Justice, instead of issuing motorists with Z69J tickets as prescribed. He used police printers to print own tickets, which was both illegal and corrupt,” wrote Gambiza in his statement to the police.

Chihuri is accused of pushing the police to fundraise for money which he allegedly used to build homes in leafy suburbs.

“The offence of not having red rear reflectors, for instance, is covered by Chapter 13:11 section 37(1) of the Road Traffic Act and was $5 fine, but Chihuri gave an illegal instruction to have his officers charge $20,” he wrote.

“Further, Chihuri, through his fake ticket books, violated the law by remitting all spot fines to the director of finance at Police General Headquarters, when this issue of admission of guilt is provided in Chapter 9:07 section 356 of the Criminal Procedure and Evidence Act and the Zimbabwe Republic Police standing orders volume 1,” Gambiza said.

The Act specifies that Z69J tickets for spot fines have the original white copy and be remitted to the clerk of court together with deposit fines.

Gambiza said he was aware that the matter had Cabinet approval and was debated in Parliament, but this did not make it law and Chihuri, as a law enforcer, was supposed to be competent enough not to implement illegal decisions.-Newsday

Tafadzwa Musarara Who Is Refusing To Pay $700 Child Maintenance Donates Groceries Worth $ 100 000 to Zimbabwe Defence Forces

The Zimbabwe Defence Forces (ZDF) has received groceries towards the provision of food in army medical institutions from Tafadzwa Musarara , who has been dragged to court by a Harare woman last year under case number M900/16, where she accused him of neglecting his child.

In its endeavour to give back to the community, the Grain Millers Association extended a helping hand to the ZDF by donating an assortment of food stuffs worth more than $100 000.

Speaking at the handover ceremony, Grain Millers Association Chairperson, Mr Tafadzwa Musarara spoke highly of the work being done by the ZDF to ensure peace and stability in the country.

Chief of Staff, Service, Personal and Logistics at the ZDF Headquarters, Major General Martin Chedondo thanked the grain millers for the kind gesture which will assist medical institutions within the defence forces.

The Court Case:

The legal battle between Grain Millers Association of Zimbabwe chairperson Tafadzwa Musarara and a Harare woman over the paternity of a 2 year old child sired out of the wedlock is continuing at the Civil Court with the former maintaining he was not the biological father.

Cynthia Wozhele last filed an application at the Civil Court under case number M900/16, where she accused Musarara of neglecting his child.

Wozhele is demanding $700 for the maintenance of the child. However Musarara in his opposing affidavit denied the knowledge of the child arguing that he had no access to Wozhele during the time of conception.

“I have no knowledge of a child called Tererai Musarara. I am applying that this court orders that a DNA test be conducted. The money that the complainant is demanding is not justifiable for a minor child,” said Musarara is his opposing affidavit.

The matter was postponed to 17 November, 2017 to allow for a DNA test to be conducted to ascertain the paternity of the minor.

Musarara has also refused to take a birth certificate of the child and has been evasive, according to Wozhele, from the time the child was born on August 12, 2015.

“Respondent’s (Musarara) assertion that he has no knowledge of our minor child falls foul and short of the truth. It suffices to mention that the respondent is the one who named our minor child Tererai,” said Wozhele in her founding affidavit.

A DNA test in Zimbabwe costs between $300 and $350.
