Zimbabwean man sentenced to death for raping stepdaughter, 3

In one of the most horrifying child murder cases many can remember, Zimbabwe’s High Court has sentenced a man to death because no extenuating circumstances could be found for the excruciating sexual abuse and mutilation of a three-year-old child.

Many were shocked when they heard about the case of Samson Mutero, 43, who raped his stepdaughter Chipochashe Ndlovu, in a remote part of central Zimbabwe in 2013 before assaulting her all over her body until she was unconscious.

He then carried her back to his home, where she died.

After he buried her, the local traditional leader became suspicious and called the police, who then had the little girl dug up and her body subjected to a post mortem where the horrifying injuries were discovered.

Mutero was found guilty in 2015 of the child’s murder with actual intent by Justice Lawrence Kamocha.

But the new Zimbabwe constitution presented technical issues which his pro amicus legal team used to appeal both conviction and sentence.

But finally this week, the original conviction was confirmed and Bulawayo’s Chronicle newspaper reported that Mutero was sentenced to death.

“I am unable to find anything which can be regarded as an extenuating circumstance, as a result, the sentence of this court is that you be returned to custody. The sentence of death be executed upon you, according to the law, Judge Kamocha said.

Zimbabwe hasn’t had a hangman for about 10 years, and there are moves by some in the legal field, in particular, vice President Emmerson Mnangagwa, to abolish the death sentence.

Man caught shooting video of married woman while she was bathing

A 29-year-old man of 234 Rujeko C Masvingo, Zimbabwe, Abraham Matenda, has been arraigned in court for shooting a video of his fellow tenant’s wife while she was having her bath.

According to Standard, Matenda appeared before Masvingo Magistrate Court for invasion of privacy/criminal insult as defined in section 95 (1) (b) of the criminal Law (Codification and Reform) Act Chapter 9:23 of the country.

The police prosecutor, Nancy Makuvise, told the Peter Madiba-led court that, on the 30th July 2017, Matenda invaded the privacy of the complainant, Mapkae Asaweyi, by placing a phone under the bathroom roof and recording a video of the complainant while bathing.

Asaweyi told the court that after discovering that there was a cell phone shooting a video of her taking a bath, she took the phone to Abraham’s wife who identified the phone as her husband’s.

The complainant then showed the accused’s wife the video which she deleted after viewing.

Matenda’s wife went on to open the phone’s gallery and found it containing another video of the complainant bathing which she also deleted

In his defence, the accused denied all the charges levelled against him, arguing that on the same day in question he was not at home and he had left his phone charging.
However, the complainant told the court that she has an audio recording of the accused admitting to have recorded the complainant while bathing.

The case was adjourned to the 11th of August 2017 to allow the accused to bring his witnesses to court.

Number of Young African Girls Trafficked to Europe for Prostitution Reaches Alarming Levels

The number of young African girls trafficked to Europe for prostitution has increased by almost 600 percent in the first half of this year.

In its report, which was released last week in Italian, the International Organization for Migration (IOM) warns that the sexual exploitation of African migrants in Europe has reached disturbing levels, with the majority of victims being young girls who are already subject to abuse on their way to Europe.

“Trafficking is a transnational crime that devastates the lives of thousands of people and is the cause of untold suffering,” says Federico Soda, director of the IOM Coordinating Office for the Mediterranean.

“This is a theme we have been working on for years, committing to protect, prevent, and collaborate with the authorities dealing with organized crime.”

The findings are based on information collected by IOM at landing sites and reception centers for migrants in different parts of southern Italy.

The organization has been working in these centers with the aim of identifying potential victims and assisting those who escape their exploiters and are willing to accept its support.

Very often the young women whom IOM staff meet have been victims of sexual violence during their journey, and they have experienced serious trauma and suffer from psychological distress.

IOM Project Manager Carlotta Santarossa says the principle purpose of the report, whose English version will be released soon, was to highlight the painful reality of the hateful form of slavery being meted out on defenseless migrants.

Santarossa has also called on all relevant agencies to carry out an urgent data analysis and an examination of the market that these girls supply as well as the growing demand for paid sexual services.

The report cites Nigeria as the main nationality to which the majority of the sex trafficking victims belong, with states like Edo, Delta, Lagos, Ogun, Anambra, and Imo being the most affected.

“IOM estimates that 80 percent of girls arriving from Nigeria – whose numbers have soared from 1,454 in 2014 to 11,009 in 2016 – are potential victims of trafficking for sexual exploitation,” the report claims.

Since 2011 after the fall of Libya’s longtime President Muammar Gaddafi, Libya has become the main transit point for hundreds of thousands of African refugees and migrants attempting to reach Europe through the Mediterranean Sea.

This mass exodus has brought in its wake an unprecedented humanitarian crisis, with thousands of migrants, including unaccompanied children, dying on their way to Europe.

While the majority of these deaths occur in the sea when the overcrowded inflatable boats capsize, others are a result of torture and other forms of abuse committed against migrants by their smugglers and captors.

Kaukonde Takes Sunday Mail To Court Over Forged O Level Certificate Report

Former Zanu PF Mashonaland East provincial chairperson, Ray Joseph Kaukonde, has filed a $100 000 lawsuit against the Emmerson Mnangagwa controlled Zimbabwe Newspapers (Zimpapers), after one of the stable’s titles, The Sunday Mail, published a story insinuating that he forged his O Level certificate.

Through his lawyers, Warara and Associates, Kaukonde filed the litigation on August 3, 2017, citing Zimpapers and Sunday Mail investigations editor, Brian Chitemba, as respondents.

Kaukonde said sometime in November 2014, the newspaper ran an article titled Ray Kaukonde faked O Level certificate.

“The article stated that the plaintiff (Kaukonde) had forged his educational qualifications to build his political and business career using an O Level certificate belonging to Ray Michael Chimbganda. It further stated that the plaintiff had bribed the family members not to expose this scandal. The concerned article stated that Ray Michael refused to discuss anything in relation to the plaintiff,” Kaukonde said in his declaration.

“The plaintiff denies the allegations of being involved in the forging of the O Level certificate as claimed by the second defendant’s (Chitemba) sources of information and states that the allegations are not correct.”

The former Mashonaland East governor added that the words in the alleged article were wrongful and defamatory as they portrayed him as dishonest.

“The second defendant failed even to solicit a simple comment from the plaintiff. As a result of the defamatory publication, the plaintiff has suffered irreparable injury and this has diminished the plaintiff’s esteem or standing in the eyes of ordinary members of the general public as this has cast aspersions on his character. This has resulted in the plaintiff being ridiculed as a leader who faked O Level certificate,” he said.

Both Zimpapers and Chitemba are yet to respond to the litigation.- Newsday

Lameck sued for $50 000 by UK based couple

A United Kingdom (UK)-based couple has slapped social media sensation Lameck Chimoka with a $50 000 lawsuit for emotional abuse.

This emerged in court after Patricia Chakanyuka Zenda and her husband, David, were granted a peace order against Chimoka who gained popularity after speaking ill of his in-laws at a funeral.

Chimoka, who is now known as Lameck among social media users, shot to fame overnight when his video went viral.

In its suit, the UK-based couple claim Lameck recorded an audio castigating them for allegedly neglecting their family back home.

Lameck is said to have made the offensive remarks while donating groceries to the couple’s relatives in Mabvuku in Harare.

In the peace order issued on August 2 at the Harare Civil Court, Lameck was ordered to maintain peace with Patricia and David by desisting from assaulting them verbally and physically.

Lameck was also prohibited from visiting the Zenda parents’ house in Mabvuku in Harare.

He was also warned that breaching the order would make him liable of contempt of court charges.

“I want to say one thing to the Zenda family; Aaron, David, Patricia and Tsitsi who live in the UK but cannot take care of their brother’s son; it is disheartening that as neighbours we are seen taking over the welfare of your relatives yet you live in expensive houses in London.

“You do not want to take care of your brother’s child just because he is disabled, which is not good . . . I am giving you 48 hours or else . . .

“Can you imagine that at the age of 16, this child has been doing ‘piece jobs’ to cater for his mother and siblings . . . I am giving you 48 hours or else I will hit you with a catapult,” Lameck is accused of saying in the audio.

Patricia and David expressed displeasure at his utterances saying they had been defamed.

“It is undeniable from the above that you have uttered, recorded and further published defamatory statements to third parties which will make people think ill of our clients.

“You made allegations portraying our clients as lacking of integrity and personal morality.

“You have chosen to defame our clients and further threatened to assault them without first gathering facts.

“Our clients have done a lot for the family in question.

“Nonetheless, we wish to stress that they do not have legal obligation to help or maintain the family and it is sad that you have assumed that our clients do not have financial problems of their own.

“Our clients are not sure why you have chosen to make your utterances without verifying some factual information and further why, you threatened to assault them,” the couple’s lawyers, Mauye Zvarevashe Legal Practitioners said.-Dailynews

Pupil dies after consuming illicit brew

A FORM Four pupil at Kotwa High School in Mutoko reportedly collapsed and died after consuming excessive amounts of an illicit brew during a drinking competition with friends.

The incident, according to police sources, who conducted the investigations, occurred on August 6, as students engaged in a weekend beer-drinking binge at a local bottle store.

The deceased, identified as Crossby Mose (18) of Meza village in Chief Mukota’s area, reportedly died on admission at Kotwa Hospital.

Efforts to contact the Mashonaland East provincial police spokesperson for comment were fruitless as his mobile phone went unanswered yesterday.

Sources said on the fateful day, Mose was at a bottle store playing snooker with Taurai Mudembo (25) and Nyasha Chataika (26).

It is reported that a fellow villager, Gift Mugavamadzi (27), entered the bottle store and offered to buy alcohol for the trio.

Mugavamadzi reportedly bought a 200ml bottle of the illicit brew and gave it to Mudembo, who gulped the contents without taking a break before he vomited.

Mose then joined the contest where he reportedly gulped 600ml of the illicit brew at once before he collapsed. He died on admission at the hospital the following morning.

Energy Mutodi arrested over facebook post

Singer and businessman Energy Mutodi was arrested this morning for an article he wrote on Facebook about why it is a difficult job for President Robert Mugabe to choose a successor, The Herald reported this evening.

Details are still sketchy about what happened.

Mutodi’s post, however, pointed to a possible coup if Mugabe did not handle things right.

He writes that there have been more than 200 successful and unsuccessful coups in Africa since 1960, adding:  “Unwillingness to peacefully handover power, failure to name a successor, ruthless crushing of dissent, economic mismanagement and state capture by those close to the incumbent are among the reasons why coups are rampant in Africa.”

“African leaders are to a large extent obsessed with power, do not know when to stop, commit countless crimes while in office and delegate power to their family members much to the disappointment of the military.

“While a military takeover maybe far fetched in Zimbabwe, it is important for President Mugabe to be careful in naming his successor. Any suspicion of unfairness or discrimination on account of tribalism or factionalism may backfire.”

Mnangagwa Denies Jailed MDC-T Activists Right To Vote

AN application by three MDC-T jailed activists to be allowed to vote from prison in harmonised elections next year is misplaced and the activists’ remedy lies with Parliament, Government said yesterday.

Responding to a High Court application by the three MDC-T activists who are serving 20 years each for murder, Secretary for Justice, Legal and Parliamentary Affairs Mrs Virginia Mabiza said electoral laws do not provide for prison voting and the applicants should ask Parliament to change the law.

Yvonne Musarurwa, Last Maengahama and Tungamirai Madzokere, were found guilty of killing police Inspector Petros Mutedza in Glen View, Harare, six years ago.

While in prison, the three — through their lawyers Mbidzo, Muchadehama and Makoni Legal Practitioners — filed a declaratory order allowing all prisoners to be allowed to cast their vote in the harmonised election.

In her opposing affidavit, Mrs Mabiza said the Electoral Act was a law of general application that can lawfully limit the right to vote.

To that end, Mrs Mabiza said the only remedy for the trio was to engage Parliament. “What applicants seek is to have it declared that all prisoners be allowed to register and vote.

“I am advised by my legal practitioner, which advice I take, that one can only be compelled to do what he is permitted by law to do and that as long as the impugned act does not violate the Constitution, the only remedy available for the applicants is to go to Parliament and ask Parliament to change the law,” said Mrs Mabiza.

Zimbabwe Electoral Commission (ZEC) chairperson Justice Rita Makarau supported the same notion. “The commission, as rightly noted by the applicants, operates strictly within the confines of the powers and functions that it is afforded in terms of the law. It cannot go beyond the bounds of what is prescribed in terms of the law.

“. . . I hasten to state that the issue that has been brought before this court by the applicants may be one that requires a legislative solution and not a judicial one,” reads part of Justice Makarau’s affidavit.

Through their legal counsel, the three prisoners argued that since they have been in prison, ZEC had neither carried out any voter education, including voter registration to enable them to cast their votes during all past by-elections.

The trio said they now want ZEC to register them as voters and facilitate their participation in any future polls.

They said they want the election body to make necessary arrangement to ensure that prisoners are registered as voters on appropriate voters’ rolls.-Herald

Businessman Energy Mutodi arrested over coup remarks

Harare – Police have arrested Vice President Emmerson Mnangagwa‘s ally, controversial businessman Energy Mutodi, for allegedly suggesting that a coup was likely in Zimbabwe if President Robert Mugabe failed to “carefully choose his successor“.

“It is true; he has been charged with undermining the authority of the president in contravention of Section 33 of the Criminal Codification and Reforms Act and causing disaffection among the police force or defense force in contravention of the Criminal Code,” said Mtetwa.

Speaking over the phone from the Harare Central Police Station where Mutodi was being held, Mtetwa said her client was initially charged with treason.

“The charge was initially treason based on an adulteration of the posting by Zimeye (an online publication) whose article gives the impression that Mutodi gave an interview to then when they simply gave the Facebook post their own interpretation and their own headline. I am not sure if they will detain him overnight,” said the defence attorney.

‘I am the boss’ 

Police spokesperson Senior Assistant Commissioner Charity Charamba could not be reached for a comment as her mobile phone went unanswered.

Amid growing calls for Mugabe to name his successor, Mutodi said that the nonagenarian had to be careful in choosing his successor and consult widely.

Mutodi allegedly wrote on his Facebook page, that the veteran leader should avoid raising “any suspicion of unfairness or discrimination” as it may “backfire” and even tarnish his name.

Said Mutodi: “Decision making in succession issues has always been a problem among Africans; resulting in civil wars, repetitive coups and economic turmoil.”

The controversial business, who recently appeared in pictures with Mnangagwa holding a coffee mug inscribed “I am the boss”, said Mugabe needed to consult with the country’s security establishment that played a key role in keeping him in power.

Man fatally struck his neighbour with a hammer on the head over $20

A MISUNDERSTANDING over a $20 debt turned tragic last week after a Dangamvura man fatally struck his neighbour with a hammer on the head, killing him instantly.

Christopher Piwa, who resides in Gimboki South, was on Tuesday hauled before Mutare magistrate, Mr Innocent Bepura, facing murder charges.

He was asked not to plead and advised to apply for bail at the High Court in Harare.

Piwa was facing a Third Schedule offence.

Public prosecutor Mr Fletcher Karombe told the court that Piwa struck the deceased, Taurai Nyakuni, on August 5.

The suspect allegedly visited the deceased at his residence in the same neighbourhood following up on a $20 debt.

“A misunderstanding arose between the two, resulting in the suspect hitting the deceased with a hammer on the head,” he said.

Upon realising that he had committed a serious offence Piwa disappeared from the scene with the murder weapon.

Neighbours tried to administer first aid on Nyakuni but it was too late.

He was pronounced dead upon admission at Mutare Provincial Hospital. A post mortem done on the deceased revealed that he died due to injuries he sustained from the hammer attack.

In his statement to the police, Piwa said he was provoked by the deceased after he approached him over the debt resulting in a fist fight. He denied ever attacking the deceased with a weapon, saying he used his hands to defend himself from the deceased who was attacking him.

However, recorded statements from neighbours who witnessed the fracas said the accused person hit the deceased with a hammer on the head.

They alleged that he disappeared with the weapon soon after committing the crime.

Piwa was later arrested by officers from Dangamvura Police Station who used his friend to call him and subsequently arrested him from a hide-out in the same neighbourhood.-Manicapost

Convict who ejaculated on victim’s buttocks is jailed 2 more years sodomising a fellow inmate

A Harare Central Prison convict on the verge of finishing serving a 10-year jail term for rape, was on Friday slapped with two more years for sodomising a fellow inmate.

Farai Makwiyana (48) appeared before Harare magistrate Ms Victoria Mashamba facing charges of aggravated indecent assault.

He sodomised his cellmate. Makwiyana was only left with two and half years from the 10-year sentence he had been serving on his previous conviction of rape.

In passing sentence, Ms Mashamba said the court was lenient in sentencing him since it had been proved that he did not penetrate the complainant, but only ejaculated on his buttocks.

She further indicated that Makwiyana managed to go through the five years he was given on his previous conviction without committing the same offence, therefore he was given a shorter term.

The prosecutor Ms Idah Maromo proved that on July 1 this year around 3am at Harare Central Prison, Makwiyana and the complainant were sleeping in the same cell and bed while naked.

The complainant felt cold, woke up and saw Makwiyana covering his head with a blanket. He touched his buttocks and discovered that he had semen. At that moment, Makwiyana started apologising for soiling his buttocks.

Makwiyana then wiped the semen and told the complainant not to disclose the matter to anyone. The complainant told the other inmates, despite Makwiyana’s plea.

In defence, Makwiyana denied the allegations saying that he did not commit the offence, because the complainant was sleeping on his back.

He told the court that he woke up early that day to smoke and that’s when he heard the complainant waking up the other inmates telling them that he had been sodomised.

Makwiyana further indicated that he only apologised and also wiped the semen, because he had been thoroughly beaten by the other convicts who were in that cell.

Prophet Manhandled at Paul Mwazha Sowe Gathering

Popular Paul Mwazha congregates were left shell shocked as a fake ‘madzibaba’ was caught in act trying to steal cash and gadgets from congregates at a recently held Apostolic gathering in Chaka.

The conman, Takudzwa Nyakwimbe is said to have pretended to be a member of the church in order to steal from congregates of the Paul Mwazha sect.

Sources at the gathering said that Nyakwimbe managed to mingle in with people as he was also clad in the white apostolic garments.

Madzibaba Petros Matandanidze said that he saw Nyakwimbe searching through people`s bags that had been left at a distance.

“I saw him taking out something from a bag and put it in his pocket and that`s when I realized that he was stealing. When I shouted for help he then began to run in an attempt to escape. Whilst running he dropped what he had stolen thinking that we would let him go but we continued chasing him as he had to be punished,” said Matandanidze.

Nyakwimbe had stolen three mobile phones and $50 cash from a bag belonging to Peter Makande.

Upon confrontation by the angry mob, the fake madzibaba said he had come to seek divine intervention over an undisclosed problem which is believed to be caused by ‘evil spirits’ or generational curses.

He also said he was shocked that people were calling him a thief as he was only trying to return the phones and money to their respective owners.

“I was only trying to return the goods to the owners because l found them lying on the ground. I am not a thief, I`m only here to get deliverance from Mwazha,” he said.

However, congregants did not believe his story as they questioned him as to the reason he was trying to flee when madzibabaMatandanidze shouted for help.

“I just got confused when people started shouting that I am a thief and I began to run without even realizing it. I think it was caused by the evil spirits that I came here to be delivered from,” said Nyakwimbe.

The matter was reported to the police and Nyakwimbe has since been arrested.

A 22-YEAR-OLD man from Bulawayo died after he was struck with a bottle on the head during a robbery.

Two unknown people who are still at large attacked Makhosini Siziba of Mzilikazi suburb while he was walking home with his friend, only identified as Timothy, from a beer drink around midnight on Friday.

The duo was coming from their regular night spot, Jika-Jika Night Club, within the suburb.

Siziba sustained a deep cut on the head and Timothy sprained a leg where he was also hit with a bottle.

They managed to walk to Ross Camp Police Station where they reported the matter before going to Mpilo Central Hospital where they were both admitted.

Siziba died on Saturday afternoon.

The assailants stripped Siziba of his takkies, jacket and shirt before grabbing his wallet containing an undisclosed amount of money and his identity particulars.

Grandmother to the deceased, Mrs Omelia Siziba (77), said Timothy informed her that they were in hospital.

“Timothy said they had been attacked at around midnight and luckily the two managed to walk to the police station where they reported the matter before proceeding to Mpilo Central Hospital.

“He phoned me around 2AM and I visited the two on the following morning. At around 6AM, Makhosini, who had been said to have been brave earlier on, couldn’t speak anymore. He didn’t even open his eyes and I noted that he was in pain.

“We suspect he had bled internally. He died later during the day,” she said.

Mrs Siziba said her grandson had narrated the ordeal to the police before he became unconscious.

“He said Timothy tried to fight the two robbers when they pounced on them and when he tried to intervene and help his friend, one of them hit him with a bottle and he lost consciousness.

“They then stripped him of his clothes, searched his trouser pockets and fled with his wallet,” she said.

A resident, a Mr Msimanga, said police should consider patrolling the suburb as it was no longer safe.

“We wish residents could be united and work hand in hand with the police to make our suburb a crime- free place. One cannot walk safely after 7PM in our neighbourhood unless they are familiar with the notorious thugs.

“It is sad a young man has lost his life to these merciless robbers who are always on the loose and ready to pounce on innocent people. They could have just demanded what they wanted rather than to injure them as this has resulted in death. How do they feel when their deeds result in death?” he said.

Top Prosecutor Gerrie Nel who jailed Oscar Pistorius sets sights on Grace Mugabe

Private prosecutor Gerrie Nel is preparing to offer his help to the Johannesburg model who accused Zimbabwe’s first lady Grace Mugabe of assault.

Nel is one of this country’s top criminal prosecutors. He successfully prosecuted former national police commissioner Jackie Selebi for corruption and Paralympian Pistorius for murder.

There is a seeming impasse SA authorities and Mugabe’s team‚ as it is believed she is seeking diplomatic immunity after she was accused of assaulting the 20-year old woman on Sunday night.

The alleged assault had taken place at the Capital 20 West in Sandton. The alleged victim Gabriella Engels‚ said Mugabe had beat her with an electrical extension cord and opened a case of assault against Mugabe on Monday.

Nel will announce how he plans to intervene later on Thursday.

AfriForum issued a media advistory stating: “Advocate Nel will announce at the conference what steps will be taken to support Ms Engels.”

When he began his new job under the helm of the civil society group AfriForum in February – heading a private prosecutions team intended to bring justice to South Africa’s political and economic untouchables – Nel said he firmly believes in the South African justice system and this is a way of assisting the National Prosecuting Authority.

He said it would not attempt to be a parallel justice system – it is a team that would only pick up cases which the NPA selects not to prosecute.

Late last month‚ The Times reported AfriForum’s private prosecutions unit had two potential cases in its sights.

The group’s CEO‚ Kallie Kriel‚ confirmed that the tenacious Nel’s unit was preparing to pursue a criminal as well as a corruption case for private prosecution.

Kriel said they were putting a lot of effort into preparing the cases‚ with an announcement planned in the next three months.

War vets fight at Heroes Acre

MINISTER of State for Bulawayo Provincial Affairs Cde Nomthandazo Moyo has warned war veterans here against washing their dirty linen in public following a factional scuffle involving the freedom fighters at the provincial Heroes Acre in Nkulumane on Monday.

There was drama at the provincial shrine on Heroes Day when the faction led by Cde Cephas Ncube barred the faction led by Cde Roy Maphosa from laying a wreath on the Tomb of the Unknown Soldier.

Police had to intervene following a war of words between the two groups of war veterans over the laying of the flowers.

Cde Moyo, who was at the Heroes Day commemorations when the incident occurred, described the war veterans’ behaviour as unbecoming, saying the heroes’ shrine is a sacred place that must be respected by everyone.

“The Heroes Acre is a place of respect and that is where the people who fought for this country were laid to rest. We therefore expect everyone to treat the shrine with respect, especially the war veterans. I’m disappointed that the people who claim to be cadres of the revolutionary struggle have shown such disdain to their comrades’ resting place.

“I have warned them against washing their dirty linen in public. It’s not our culture to fight at the grave site. We all have issues but the last thing I expect is for people to fight at the Heroes’ Acre. In our culture it’s not acceptable. It was disappointing for the war veterans to fight in front of families who had come to attend the event in memory of their loved ones,” said Cde Moyo.

She added that nobody had the right to stop people from showing love and respect to their departed loved ones.

“No one has the right to stop other people from showing their love and respect to their departed loved ones. That place belongs to the State and everybody has free access as long as they respect the place.

“As Minister of State for Bulawayo, I am responsible for the Heroes Acre and whenever such incidents occur it’s my duty to make sure it doesn’t happen again. I personally feel that the war veterans need to look for other places to resolve their issues, not the provincial shrine,” said Minister Moyo.

The ugly face of factionalism manifested when Cde Maphosa was pushed aside by a protesting group of war veterans who chanted slogans and insulted him when he tried to lay a wreath on the Tomb of the Unknown Soldier.

This was after Cde Moyo and Cde Ncube had already laid wreaths on the tomb.

Cde Maphosa finally managed to lay the wreath after police intervened.

Meanwhile, Welfare Services for War Veterans, War Collaborators, Former Political Detainees and Restrictees Minister Retired Colonel Tshinga Dube will meet war veterans in Gwanda today and in Bulawayo tomorrow.

Rtd Col Tshinga Dube confirmed the meetings, saying they would be discussing issues that affect the freedom fighters.-herald

Small house to pay $8k adultery damages

The High Court has warned it will not fold its arms and let society drift into immoral decadence under the canopy of ill-perceived rights. Justice Hlekani Mwayera said the matrimonial bond was undeniably protected by the Constitution which sanctions the marriage institution. She said this while awarding $8 000 to Georgina Njodzi who had sued her husband’s lover Lorraine Mationa for adultery.

Njodzi was legally married to Lawrence Muzvondiwa Njodzi for 22 years at the time the illicit affair was birthed and conceived a child.

She claimed adultery damages to the tune of $25 000, which was split into $15 000 for contumelia and $10 000 for loss of consortium.

But Justice Mwayera reduced the claim to $8 000 for both contumelia and loss of consortium.

“Any intrusion to the detriment of marriage institution in situations where the intruder has knowledge or ought to have knowledge should not go unchecked,” said Justice Mwayera.

She said the delictual claim for adultery damages was still relevant in a progressive society like Zimbabwe which has its social values sanctified in the supreme law of the country.

“The quantum of damages should not be a mockery to the aggrieved party lest the judicial system falls into disrepute and run the risk of being held in complicity with the adulterous couple,” she said.

Justice Mwayera said where evidence was flawless as in the case, that Njodzi was injured, insulted and subjected to indignity contumelia umbrella damages were justified.

The judge noted that from 2012 to the time of hearing the matter, Njodzi suffered loss of consortium.

“Given the duration of the marriage and initial cordial relationship of the parties, the disruption brought about by the adultery is of great magnitude and it calls for a fairly high award in damages. This is more so when one considers the unrelenting personality of the defendant (Mationa).”

The case, which started off with a pre-trial conference, was referred to trial after parties failed to hammer a settlement.

The court had to determine whether Mationa committed adultery with Njodzi’s husband. Other issues for determination were whether Njodzi was entitled to contumelia and consortium as well as payment of $25 000 as damages.

Last year, Mationa, a nurse at Harare Central Hospital, had her constitutional application seeking to abolish adultery law by the same court thrown out.

Justice Mwayera, who dealt with the constitutional application at the time ruled that adultery damages were a legal claim meant to protect the sanctity of marriage and they remained part of the country’s laws.

The ruling was a direct challenge to the status in neighbouring South Africa, which two years ago outlawed adultery damages, a decision that was celebrated by Zimbabweans.

This had inspired Mationa to launch a constitutional application contesting a suit against a third party over the breakdown of a marriage.

But Justice Mwayera said decisions of the South African court or other foreign courts to declare such damages unconstitutional were not binding in Zimbabwe.

Justice Mwayera said in terms of Zimbabwean policy and values, adultery remains wrongful and the claim for damages was justified as it serves to compensate the injured party.

Matione wanted adultery to be abolished saying it violated the third party’s rights to privacy and equality before the law.

She was accused of knowingly having an adulterous affair with Mr Muzvondiwa that resulted in the birth of child.

Porn videos expose affair with pupil

A CHIKANGA shopkeeper, who allegedly quenched his sexual appetite on a Form One pupil, has been exposed after the 15-year-old girl was found in possession of pornographic material at school.

The minor, who cannot be named because of her age, was found in possession of pornographic video discs at Chikanga Secondary School, prompting the headmaster to question her about their origins.

The girl revealed that she was given the discs by her boyfriend, Terry Mpandira (21).

A police report was subsequently made leading to Mpandira’s arrest. The minor was sent for medical examinations at Mutare Provincial Hospital to ascertain if she was abused.

Mpandari appeared before Mutare magistrate Mr Innocent Bepura on Tuesday charged with having sexual intercourse with a young person, as defined in Section 70 (1) (a) of the Criminal Law (Codification and Reform) Act Chapter 9: 23.

He pleaded guilty to the charge but his plea was altered to a plea of not guilty by the court after he professed ignorance of the minor’s age..

“Your Worship, I do not deny having sexual intercourse with her. She was my girlfriend and she had told me that she was 18 years old,” argued Mpandira.

He insisted that she was 18 years old and claimed that she indeed looked 18. He, however, failed to answer when asked on why he thought the girl was 18 years old when she was only doing Form One.

Mr Fletcher Karombe told the court that sometime in October last year, Mpandira proposed love to the juvenile and they started dating.

A month into the relationship, Mpandira invited the 15-year-old to his workplace and took her to the backroom that he used as his bedroom.

“Once in his bedroom, he asked for sexual favours, which he was granted. Mpandira is alleged to have later used his towel to clean the juvenile’s private parts after being intimate with her.

“They also had consensual sexual intercourse on four other different occasions. On all occasions they did not use protection. On August 4, the juvenile was found in possession of a pornographic disc at school and she was summoned for questioning by the headmaster,” said Mr Karombe.

Upon being cross-xamined, she revealed her sexual relationship with Mpandira to her headmaster and her uncle was called.

The matter was adjourned to August 24. Mpandira was granted $50 bail. – Manica Post

Man bashes wife for wearing trousers

A Zvishavane man bashed his wife with a metal rod and knobkerrie for wearing a pair of trousers.

Energy Zendera (31) has since appeared in court and was fined $150. He risks 25 days in jail if he fails to pay the fine. Zvishavane magistrate Mr Archie Wochiwunga sentenced Zendera to three months in jail, but suspended the sentence for three years on condition he does not commit a similar offence.

Mr Wochiwunga said cases of domestic violence were rampant in Zvishavane. He said Zendera should have resolved the dispute with his wife amicably.

Zendera explained that his wife, Nomsa Ndhlongwa, got furious when he cautioned her against wearing a pair of trousers. Ndhlongwa allegedly told Zendera she deserved a better man.

The prosecutor Mr Stanley Ncube proved that Zendera beat up his wife following the argument.

A HARARE man had his eye gouged out after he intervened and tried to restrain five junior police officers, who were allegedly bashing his wife for no reason in the central business district five months ago.

The police officers – Livingston Zvimba, Tendai Musungambira, Sunday Nyaude, Khululekani Dale and Evans Mashonganyika – yesterday appeared in court charged with assaulting Yvonne Magora and her husband Washington Gezana.

They denied the allegations, telling trial magistrate, Farai Gwitima that they could not be held accountable since the alleged incident occurred late at night.

The trial was postponed to tomorrow.

Allegations are that on March 23 this year at corner Kenneth Kaunda Avenue and Julius Nyerere Way in Harare, one of the accused police officers confronted Magora and Gezana and asked them why they were standing at the road intersection, where they were controlling traffic.

They allegedly then assaulted Magora with open hands and batons before Gezana intervened to rescue his wife.

The State alleges all the suspects then turned on Gezana and assaulted him with batons, open hands and an unknown object, which then gouged his right eye.

Realising that they had injured Gezana, the police officers jumped into their service vehicle and drove off, as well-wishers stopped by and took the couple to Parirenyatwa Hospital for treatment. Gezana’s eye was subsequently removed, as it had been severely damaged.

Sex workers shock city with video

Four hard core sex workers in the high density suburb of Mucheke have shocked Masvingo with a video that has gone viral in which they pitilessly strip a client of his clothes in broad daylight before assaulting and robbing him of his money.
The four; Shelter Chinomwe (33), Maria Sengai (21), Mavis Chinomwe (27) and another one who is now on the run  then went about pulling the client by his manhood as hordes of children and neighbours watched.
The incident happened two weeks ago (Sunday 30 July 2017) and Police swiftly arrested the sex workers on Wednesday this week after the video leaked on Monday.
Although Police Spokesperson Kudakwashe Dhewa said the case was not reported, The Mirror established that the three sex workers were being detained at Chikato Police Station and a docket RRB number 3163171 has been opened against them
The Mirror understands that the sex workers are part of a large network of sex workers who are putting the law into their hands by trapping, terrorising and robbing clients. The Musana Wezhou area near Mucheke rank is now notorious for such criminal activities.
The Mirror in January reported an incident in which a senior Police officer had his uniform impounded by sex workers in from the same area. The Cop was forced to wash blankets at a sink outside the house while naked.
Another client was stripped naked and he ran and hid in a hill behind the former Mandava Hotel until Good Samaritans brought something to cover him. A man from Chipinge had his mobile phone impounded by the sex workers last week and he said he was not reporting the matter to the Police but would use other means to force the sex workers to return the gadget.
It is suspected that he was implying that he would use juju’s against the workers.
In the latest incident, the video shows the four sex workers pinning the young client to the ground. One of the sex workers is seen squashing the client’s hand on the ground with her boot. They then pull off his shirt, trousers and underpants and leave him with just a pair of socks on.
The sex workers are also seen clapping the naked young man in the face as he desperately seeks somewhere to hide himself. The sex workers also pull the client by his organ as gathered members of the public plead for mercy and warn the sex workers that they would kill the man.
Children are seen giggling in the background as they watch the offending scene.
People who spoke to The Mirror have expressed fear that serious crimes including murder could soon be reported in Mucheke as the sex workers get more and more daring in their criminal activities.
One sex worker in the area is known to be one of the biggest mbanje peddlers in the city.
